Notice of Privacy Practices

Your Information. Your Rights. Our Responsibilities.

Effective date: October 12, 2026

This notice explains how health information about you may be used or disclosed, how you can access that information, and the responsibilities of TrailBlazier Counseling & Consulting. Please review it carefully.

Your Rights

You have the right to:

  • Request an electronic or paper copy of your health record.

  • Ask that incorrect or incomplete information be corrected.

  • Request that we communicate with you in a particular way or at a particular location.

  • Ask us to limit certain uses or disclosures.

  • Request a record of certain disclosures.

  • Receive a paper or electronic copy of this notice.

  • Choose an authorized person to act for you.

  • File a complaint if you believe your privacy rights have been violated.

Accessing Your Health Record

You may ask to inspect or receive an electronic or paper copy of your health record and other health information we maintain about you.

We will respond within the timeframe required by law. In some circumstances, Florida law permits a psychotherapist to provide a treatment report instead of copies of particular psychotherapy records. A reasonable, cost-based fee may apply when permitted by law.

Correcting Your Record

You may ask us to correct information that you believe is inaccurate or incomplete. We may deny the request in certain circumstances, but we will explain the reason in writing within the timeframe required by law.

Confidential Communications

You may ask us to contact you in a particular way—for example, through a specific telephone number—or to send communications to a different address. We will accommodate reasonable requests.

Requests to Limit Uses or Disclosures

You may ask us not to use or disclose certain information for treatment, payment, or practice operations. We are not always required to agree, particularly when the restriction could affect care or legal compliance.

If you pay for a service entirely out of pocket, you may ask us not to disclose information about that service to your health insurer for payment or operational purposes. We will honor that request unless disclosure is required by law.

Accounting of Disclosures

You may ask for a list of certain disclosures made during the six years before your request. This list generally will not include disclosures for treatment, payment, practice operations, disclosures you authorized, or certain other disclosures excluded by law.

One accounting within a 12-month period will be provided without charge. A reasonable cost-based fee may apply to additional requests.

Personal Representatives

If a person has legal authority to act on your behalf, such as a legal guardian or an agent under a valid health care power of attorney, that person may exercise your privacy rights. We will verify the person’s authority before taking action.

Rights involving minors and access to a minor’s information are handled according to applicable federal and Florida law and the circumstances of the minor’s care.

Your Choices

You may tell us whether and how we may share relevant information with family members, close friends, caregivers, or other people involved in your care or payment for care.

If you cannot communicate your preference, we may share limited information when we reasonably believe it is in your best interest or when necessary to reduce a serious and imminent threat to health or safety.

Your written authorization is generally required for:

  • Marketing that involves your protected health information.

  • Selling your protected health information.

  • Most uses or disclosures of psychotherapy notes.

  • Other uses or disclosures not described in this notice.

TrailBlazier does not sell protected health information and does not use it for fundraising.

If you give written authorization, you may revoke it in writing at any time. Revocation will not affect actions already taken in reliance on your authorization.

How We May Use or Disclose Health Information
Treatment

We may use your information to provide counseling and coordinate your care. With appropriate authorization or as otherwise permitted by law, we may communicate with other professionals involved in your care.

Practice Operations

We may use information to operate the practice, manage services, improve quality, supervise authorized providers or contractors, maintain records, and contact you about appointments or care.

Payment

We may use or disclose information to bill you, process payment, or submit claims to an insurer or other payer when applicable.

Public Health and Safety

When permitted or required by law, we may disclose information for limited purposes such as:

  • Reporting suspected abuse, neglect, or exploitation.

  • Preventing or reducing a serious and imminent threat to health or safety.

  • Responding to certain public-health requirements.

  • Complying with lawful health-oversight activities.

Legal Requirements and Proceedings

We may disclose information when required by federal or Florida law or in response to a valid court order, subpoena, administrative proceeding, workers’ compensation requirement, law-enforcement request, or government oversight activity.

Any disclosure will be limited to what is legally required or permitted.

Medical Examiners and Funeral Directors

When permitted by law, information may be disclosed to a coroner, medical examiner, or funeral director following a person’s death.

Research

Health information will be used or disclosed for research only when permitted by law and when required protections or authorizations are in place.

Florida Confidentiality Protections

Communications between a client and a professional licensed under Florida’s counseling and psychotherapy laws are confidential. We will not disclose mental-health treatment records without written authorization unless disclosure is permitted or required by federal or Florida law.

Certain legal exceptions may include mandatory reporting, health or safety emergencies, an imminent threat of serious harm, authorized treatment or payment activities, regulatory oversight, or a valid legal process.

Substance-Use-Disorder Records

To the extent that TrailBlazier maintains substance-use-disorder patient records protected by 42 CFR Part 2, those records receive additional protections.

Such records generally will not be used or disclosed in a civil, criminal, administrative, or legislative investigation or proceeding against you without your written consent or a qualifying court order and subpoena. You will receive clear notice and a choice before Part 2 information is used for fundraising communications.

Our Responsibilities

TrailBlazier is responsible for:

  • Maintaining the privacy and security of protected health information.

  • Following the duties and privacy practices described in this notice.

  • Providing you with a copy of this notice.

  • Notifying you promptly if a breach may have compromised your information.

  • Using or disclosing only the information reasonably necessary for an authorized purpose when applicable.

  • Not retaliating against you for exercising your privacy rights or filing a complaint.

We will not use or disclose your information in ways not described in this notice unless you authorize us to do so in writing or another use or disclosure is permitted or required by law.

Changes to This Notice

We may revise this notice. A revised notice may apply to information we already maintain as well as information created or received after the revision.

The current notice will be available on this website, upon request, and at [OFFICE OR SERVICE LOCATION].
